Sweepstakes starts on or about the Start Date and ends on the End Date.
HOW TO ENTER: The Sweepstakes begins at 12:00 AM CT on February 19, 2009 and ends at 11:59 PM CT on March 1, 2009 (the "Entry Period"). To enter, complete the official entry form, which is located at http://dietdrpepperdate.yahoo.com. You must have a Yahoo! ID to register. If you are not an existing Yahoo! ID holder, follow the instructions to register for a free Yahoo! ID. Follow the instructions to completely fill out and submit the ID registration form. You will be asked to provide your first and last name, physical mailing address (no post office boxes), date of birth, telephone number, and email address. You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Sweepstakes. You will then be asked to vote for your favorite speed dating couple. All entries must be received by 11:59 PM CT on the last day of the Entry Period.
For purposes of these Official Rules, "receipt" of an entry occurs when Yahoo!'s servers record the entry information upon clicking the "Submit Entry" button. In the event of a dispute regarding the identity of the holder of the Yahoo! ID, dispute will be resolved in favor of the individual who is both the authorized holder of the Yahoo! ID and password associated with the account (based upon information submitted at the time the account was created or updated upon registration for this Sweepstakes) and, if available, the "authorized email account holder" of the "alternate email address" provided when the Yahoo! ID was created. "Authorized email account holder" is defined as the natural person assigned an email address by an internet access provider, online service provider, or other organization (i.e., business, educational institution) responsible for assigning email addresses for the domain associated with the submitted email address. If there is a discrepancy between the name of the person listed as the authorized holder of the Yahoo! ID and the authorized email account holder of the alternate email address provided when the Yahoo! ID was created, that Yahoo! ID will be disqualified and prize will be forfeited. Potential prize winner may be required to provide Sweepstakes Entities with proof that he/she is the authorized Account holder as described above.
LIMIT ONE VOTE AND WIN ENTRY PER PERSON AND YAHOO! ID PER DAY. Multiple attempts to vote/enter on the same day will be disqualified. The submission of an entry is solely the responsibility of the entrant Entries may only be made according to the method described above. Proof of sending (such as an automated computer receipt confirming delivery of email, "thanks for entering" message or post office receipt) does not constitute proof of actual receipt by Sponsor and/or Yahoo! of an entry for purposes of these Official Rules. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by Sweepstakes Entities before the end of the specified entry period will be included in the prize drawing. Illegible, unintelligible, incomplete, garbled, or mutilated entries will be disqualified. All entries become the property of Sponsor and Yahoo!, and none will be acknowledged or returned. The following applies to voting: Multiple voters are not permitted to share the same email address. Any attempt by any voter to submit more than the permitted number of votes by using multiple/different email addresses, identities or any other method may, in Sponsor's and Yahoo!'s sole discretion void that voter's submission and votes and he/she may be disqualified from further participation in the Sweepstakes. Use of any automated system to vote is prohibited and all such votes shall be void.
THE DRAWING: Winners will be selected by random drawing from among all entries. Odds of winning depend on the number of eligible entries received.
GRAND PRIZE: One (1) Grand Prize winner will receive a trip for two (winner and companion) to Paris, France. Prize package includes round trip coach class air transportation for winner and winner's companion from a major U.S. airport close to winner's home (carrier and airport to be selected by Sponsor) to Paris, France; hotel accommodations (one room, standard, double occupancy) for four (4) nights; round trip ground transportation for two (2) between Paris airport and hotel; daily continental breakfast for two (2) at the Paris hotel; dinner for two (2) at Le Petit Troquet or a similar restaurant selected by Sponsor, awarded as $250 USD, a half-day (4 hour) walking tour of Paris for two (2), and $500.00 USD. Approximate retail value of Grand Prize: $10,750.00. Grand Prize value may vary depending upon the actual cost of air transportation from point of departure and accommodations at time of reservation).
INDULGENCE PRIZES: Eleven (11) Indulgence Indulgence Prize winners will each receive a prize package consisting of an indulgence prize (described below), as well as a $100 Dave & Buster's Power Play Card, and a year's supply of Diet Dr Pepper, which consists of One (1) pack of (24) coupons for a Free 12-pack of Dr Pepper product, valued at $119.76. Selections are subject to product availability. ARV $319.76
Each Indulgence Prize winner will receive one of the following indulgence prizes. Prize selection and form of award will be determined by Sponsor at Sponsor's sole discretion:
- 2 winners - Dinner for two 2 (awarded as either $100 cash or a gift card)
- 2 winners - Movie night: movie tickets and appetizers and drinks (awarded as either $100 cash or in the form of gift cards)
- 2 winners - Romance package: Brunch for 2 and flowers: (awarded as either $100 cash or in the form of gift cards)
- 2 winners - Wine tasting: Wine tasting for two at a local wine bar (awarded as either $100 cash or a gift card)
- 2 winners - A night in: DVD and dinner take away: (DVD selection at Sponsor's sole discretion. Dinner take away awarded either in the form of a gift certificate or cash. ARV: $100)
- 1 winner - Spa collection: a package consisting of various soaps, salts, and candles, selected by Sponsor (ARV $100)
The following applies to the Grand Prize: Except as specifically provided herein, travel prize package does not include taxes, insurance, telephone charges, personal expenses, travel arrangements between winner's home and U.S. airport of departure, ground transportation, gratuities, departure taxes, incidental charges, or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the prize winner. Winner and travel companion must have valid passports for international travel and must be able to travel between May 1, 2009 and December 31, 2009. If Sweepstakes Entities cannot find a winner who is able to travel on required dates in time to satisfy verification procedures, no Grand Prize will be awarded. Winner and travel companion must have valid passports by the date of travel. Winner and travel companion must agree to trip sponsor's (a representative of Sponsor) Terms and Conditions. Once confirmed, trip dates and travel accommodations cannot be changed by winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond Sweepstakes Entities' control. Winner and travel companion must travel on the same dates, itinerary, and fare class. All travel in this Sweepstakes must be completed by December 31, 2009. No extensions will be permitted, and any unused travel will be forfeited. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. All tickets issued in conjunction with travel prize are not eligible for frequent flyer miles, and no code-share flights may be used.
The following applies to all prizes: Approximate retail value of all prizes: $14,267.36. Limit one prize per winner. Prizes may not be transferred or assigned except by Sponsor. Prizes cannot be used in conjunction with any other promotion or offer and may not be separated. Only listed prizes will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Sponsor reserves the right to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner of that prize. Sponsor and Yahoo! expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded. Sponsor and Yahoo! make no representations or warranties concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Sweepstakes Entities will not replace any lost or stolen prize items.
LIMIT ON PRIZES: Limit of one prize (valued at $600 or more) allowed per person/household per 12 consecutive month period in any promotion sponsored by Sponsor or any of its affiliated companies.
WINNER SELECTION AND NOTIFICATION: Potential Indulgence Prize winners will be selected in a series of random drawings to be held daily beginning February 20, 2009 from among all entries received during the previous day. Potential Grand Prize winner will be selected in a random drawing to be held on or about March 23, 2009 from among all entries received during the Entry Period. Odds of winning depend on the number of eligible entries received. All prize drawings will be conducted by an independent judging organization, whose decisions are final.
Potential winners will be notified within 24 hours after drawing date via email, U.S. mail, telephone and/or by overnight courier. Prize winners and their travel companions, if applicable, may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information (such as social security number), that may be required by Sweepstakes Entities. Potential winners must return all required documents (if applicable, together with travel companion's required documents) within 48 hours following attempted notification or prize may be forfeited. Return of any prize/prize notification as undeliverable, or inability of Sweepstakes Entities to contact a potential winner may result in disqualification and selection of an alternate winner by random drawing. If applicable, winner may be issued an IRS Form 1099 which documents the value of the prize for tax purposes. Any difference between actual value of a prize and the approximated value of a prize in these Official Rules will not be awarded.
ELIGIBILITY: To enter you must be a legal resident of the fifty United States and the District of Columbia and at least 18 years or the age of majority in your state of residence at the time of participation. You are not eligible if you or any member of your immediate family or household (whether or not related) is (A) an employee, officer or director of (1) Sponsor, its bottlers or distributors, respective parent, affiliated and subsidiary companies, (2) Yahoo! Inc., any promotional partners, advertising or promotions agencies, suppliers of Sweepstakes materials, internet promotion developers, judging or administration organizations, or auditing or legal firms and other parties engaged in the production, promotion, administration or execution of the Sweepstakes (collectively with Sponsor, the "Sweepstakes Parties"), (3) redemption/recycling centers, (4) an owner/operator or person responsible for purchasing or promotion decisions at retailers that sell Sponsor products; and/or (5) a winner of a prize (valued at $600 or more) in any promotion sponsored by Sponsor or any of its affiliated companies in the past twelve months. "Immediate family" means parents, children, stepparents, stepchildren, siblings, stepsiblings and spouses, whether or not living at the same residence. Winners must have a valid Passport to accept Grand Prize.
GENERAL CONDITIONS: This Sweepstakes is governed by the laws of the State of Texas. All federal, state and local laws and regulations apply. By participating, you accept and agree to abide by the Official Rules and all decisions of the Sweepstakes Parties, which are final and legally binding in all respects. No substitution or transfer to a third party of all or any part of prize permitted. If, for any reason, a prize cannot be awarded or winner is not capable of redeeming a prize, Sponsor is not obligated to award it and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize) with a prize of comparable or greater value or cash value. If, for any reason, more prizes are available or claimed than the stated number, Sponsor reserves the right to randomly draw winners from eligible prize claimants in such prize category. Winners are solely responsible for all federal, state and local taxes, if any, on prizes and any expenses not specifically awarded in the Official Rules, and may be issued an IRS Form 1099 that documents the value of the prize for tax purposes. Non-compliance with these Official Rules may result in disqualification. You are not a winner unless and until (A) your entry is received (B) you have fully complied with the Official Rules and (C) all verification and award processes have been completed. Acceptance of prize constitutes permission for Sponsor and its designees to use winner's name and/or likeness for purposes of advertising and promotion in any medium, without further compensation, except as prohibited by law.
RELEASE OF LIABILITY: BY ENTERING THE SWEEPSTAKES, YOU HEREBY AGREE THAT IN NO EVENT WILL SPONSOR OR THE SWEEPSTAKES PARTIES BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSEL FEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:
- THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE SWEEPSTAKES (OR YOUR PARTICIPATION IN IT);
- CANCELLATION, MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE SWEEPSTAKES;
- USE OF ANY WEB SITE(S) RELATED TO THE SWEEPSTAKES OR MATERIALS ON THE WEB SITE;
- ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE; OR
- PARTICIPATING IN OR TRAVELING TO ANY SWEEPSTAKES-RELATED ACTIVITY.
Except where prohibited by law, a winner's acceptance of a prize constitutes permission for Sweepstakes Parties to use such winner's name, address (city and state only), statements, photograph, video, voice or likeness for any advertising and promotional purposes relating to the Sweepstakes without further compensation, consideration, review or consent.
LIMITATIONS: Neither Sponsor nor any other Sweepstakes Party is responsible for:
- lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email;
- any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues;
- unauthorized access, tampering, hacking, theft or destruction; or
- other technical or human error in the receipt or processing of entries, game piece requests or other submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Sweepstakes.
TAMPERING/VIOLATIONS/DISRUPTION: Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Sweepstakes or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person, or violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service.
CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.
CANCELLATION/MODIFICATION: Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Sweepstakes if the Sweepstakes is not capable of running as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Sweepstakes).
NO PRIZE WARRANTY: WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
DISPUTES: IF NOT RESOLVED THROUGH DIRECT DISCUSSIONS, ANY CLAIM SHALL BE RESOLVED BETWEEN PARTICIPANT AND SPONSOR BY FINAL AND BINDING ARBITRATION WITH AN EXPERIENCED ARBITRATOR LICENSED TO PRACTICE LAW IN TEXAS. FORUM AND VENUE FOR ANY ARBITRATION PROCEEDINGS WILL BE IN COLLIN COUNTY, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE RULES, BE LIMITED TO ACTUAL OUT OF POCKET DAMAGES, AND SHALL NOT, IN ANY EVENT, INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEY'S FEES OR COSTS OF BRINGING A CLAIM, OR ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF.
