GRAND PRIZES:
Two Grand Prizes: Two (2) Grand Prize winners will each receive a trip for one to Paris, France; a Dave & Buster's Power Play card; and a one-year supply of Diet Dr Pepper. ARV $8,044.76 USD per each Grand Prize.
HOW TO ENTER:
- RSVP to Attend 1 of 3 Speed Dating Events: Go to the Promotion Site, click on the RSVP button to RSVP to attend 1 of the 3 Speed Dating Events.You must be signed in using your Yahoo! ID in order to RSVP. If you are not an existing Yahoo! ID holder, follow the instructions to register for a free Yahoo! ID. Follow the instructions to completely fillout and submit the ID registration form.You will be asked to provide your first and last name, physical mailing address (no post office boxes), telephone number, and email address. You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Contest. You will be asked to download the Contest Entry Documents to be completed and submitted at the event. EACH SPEED DATING EVENT IS LIMITED TO 200 PARTICIPANTS. RSVP-ing is recommended but not required to attend the Speed Dating Event; however, those who have RSVP'ed will be admitted before walk-Ins. Walk-ins will be accepted on a first come, first serve basis after those who have RSVP'ed. YOU MUST BE UNMARRIED AND WITHOUT A CURRENT SIGNIFICANT OTHER IN ORDER TO ATTEND A SPEED DATING EVENT.
- Attend 1 of the 3 Speed Dating Events. You must present a driver's license or government identification and if you have RSVP'ed, your Yahoo! ID, to enter the Speed Dating Event. While at 1 of the Speed Dating Events, you must participate in the speed dating process.You must comply fully with the rules of the event, including completion of your score card.
- Complete all Entry Forms and Required Documents. At 1 of the Speed Dating Events, complete a Contest Entry Form including your actual first and last name and residential address (as they appear on your driver's license or governmental identification), birth date, gender, email address, telephone number and marital status. You will be asked a question about why you should win the contest. You must provide answers to all questions on the entry form. In addition, you must be willing to agree to undergo and authorize a background investigation conducted by an entity designated by Sponsor or Sponsor's representative and agree to sign all documents necessary and requested by Sponsor, necessary to investigate, access and collect information about you or any of the statements made in your entry form. You must also be willing to and sign a publicity release form and appear in a videotape produced by Sponsor or Sponsor's representative to be used on the Promotion Site.
LIMIT ON SPEED DATING EVENTS: Participants may only attend one (1) Speed Dating Event and receive one (1) entry into theContest.
The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the method described above. Unintelligible, incomplete, or garbled entries may be disqualified. All entries become the property of the Sponsor, and none will be acknowledged or returned.
No Automated Entries. You must complete your own entry form without the use of any automated Contest entry filling services or form filling services. The use of any automated, programmed, robotic or similar system to enter is prohibited and will result in disqualification. Entries filled out by anyone other than you will be disqualified. Auto entries prohibited.
Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times in violation of applicable entry limitations may be disqualified.
JUDGING: After completing the dating portion of the event, participants must submit their score card, on which participants will have selected three individuals with whom they would like to go on a date to Paris, to the event coordinators. Participants must have a "match" on your speed dating score card (i.e., you and another entrant must have included the other person on his or her list indicating that you would be willing to go on a date to Paris together) in order to be considered as a Potential Finalist Couple (individually a "Potential Finalist," together as a couple, "Potential Finalist Couple"). Potential Finalist Couples will be judged by an independent panel of qualified judges based on thefollowing criteria:
- (a) Fifty Percent (50%) - Enthusiasm and charisma
- (b) Fifty Percent (50%) - Compatibility with the Love at First Sip theme, as demonstrated in the written response on the entry form questions and in person at the Speed Dating Events.
NOTIFICATION OF FINALISTS: Three Potential Finalist Couples from each Speed Dating Event (a total of 6 individual participants) will be selected by the judges based on the judging criteria above. Potential Finalist Couples must be willing to appear in a videotape produced by Sponsor or Sponsor's representative to be used on the Promotion Site for the voting phase of the Contest. Following a background check, one of the three Potential Finalist Couples will be selected by the judges as the Finalist Couple for that event. The couple selected as the Finalist Couple from each Speed Dating Event will be notified by telephone, mail or email, approximately twenty-four hours following the event.
VOTING: During the Voting Period, Finalist Couples' names, location and videos will be featured on the Promotion Site, and site users will be able to vote for the Finalist Couple that they would like to win the Grand Prize, using the following judging criteria: (a) enthusiasm and charisma (50%) and compatibility with the Love at First Sip theme, as demonstrated in the Finalist Couple's video (50%). Each person/Yahoo! ID holder will be permitted one vote per day during the Voting Period, based on the judging criteria above. In the event of a tie, the winners will be selected by a panel of qualified judges, based on the same judging criteria set forth above.
LIMIT ON VOTES: Limit of one vote per person per day using a single Yahoo! ID. No person may enter votes by proxy for any other person. The Finalist Couple that receives the most votes during the Voting Period will becomethe potential Winning Couple.
GRAND PRIZES:
Each person in the Winning Couple will win a Grand Prize Package (for a total of two (2) Grand Prizes), each consisting of the following:
A one (1) year supply of DIET DR PEPPER, awarded as 24 coupons each for 1 free 12-Pack of Diet Dr Pepper (ARV: $119.76 USD)
One (1) Dave &Buster's Power Play Card. Card subject to terms and conditions of Dave & Buster's. (ARV: $100.00 USD)
THE WINNING COUPLE MUST BE WILLING TO TRAVEL TOGETHER ON THE TRIP, AT A MUTUALLY AGREED UPON DATE AMONGSPONSOR AND PRIZE WINNERS, BETWEEN MARCH 18, 2009 AND MAY 13, 2009. All travel must be completed by May 13, 200 9or prize may be forfeited. No extensions will be permitted, and any unused travel will be forfeited. Each trip includes: round trip coach air transportation from the major U.S. airport nearest the winner's home to Paris, France; one hotel room for four (4) nights (standard, double occupancy) lodging; round trip ground transportation between winner's home and U.S. airport and Paris, France airport and Paris, France hotel; dinner at Le Petit Troquet or a similar restaurant selected by Sponsor, awarded in the form of $125 USD cash; $250 USD spending money, awarded in cash and one (1) half-day walking tour of Paris. Hotel stay includes a daily breakfast. Winners must travel together on same flight and hotel date itinerary, and each winner shall be required to sign and return a release of liability/publicity prior to issuance of travel documents. Travel arrangements shall be through Sponsor's agent, on a carrier of Sponsor's choice. Certain restrictions/blackout dates may apply, and travel is subject to applicable provider's terms and conditions. Winners are responsible for all other travel expenses not specifically listed herein as being awarded. Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. Winners shall be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (collectively, "Affidavit") within 72 hours of issuance or the prize will be forfeited. Limit one prize per winner. All other expenses, not specifically mentioned herein, including all applicable taxes, are the sole responsibility of the Grand Prize winners. Portions of prize may be subject to cancellation.
Total ARV of each winner's prize: $8,044.76 USD. Total ARV of all prizes: $16,089.52. Actual value may differ based on winner's point of departure and cost of travel and accommodations at time of reservation. Any difference in prize value will be awarded.
Except where prohibited by law, potential Finalist Couples must return all required documents (together with travel companion's required documents) within 72 hours following attempted notification or prize may be forfeited. Return of any prize/prize notification as undeliverable, or inability of Contest Entities to contact a potential winner may result in disqualification and selection of an alternate winner according to the judging criteria above.
Winners accept all risks of accepting the Grand Prize, including travel to Paris with other Grand Prize Winner. Though on same flight and hotel itinerary, Winners shall be free, at their sole discretion, to proceed with the travel, "date" or other relationship with the other Winner, any time after the Speed Dating Events, including while traveling to and in Paris. No replacement prize or value, however, shall be offered.
PRIZE NOTIFICATION: Potential Grand Prize winners will be notified by email, phone and/or mail within 1 week after the Voting Period. If after a reasonable number of attempts during a day (as determined by Sponsor or Administrator in its sole discretion), contact is not made with winner, prize will be forfeited and an alternate winner selected. Winner will be required to sign an Affidavit within seventy-two (72) hours or prize will be forfeited. If mail is returned as undeliverable without a forwarding address, then prize maybe forfeited. Alternate winners for forfeited prizes may be selected at Sponsor's sole discretion. If Contest Parties can not find a sufficient number of winners who are able to travel on required dates, not all prizes will be awarded. Prize will be awarded upon receipt of Affidavit, and verification of prize winner.
ELIGIBILITY: To enter you must be a legal resident of the fifty United States and the District of Columbia, unmarried, without a significant other, and 21 years or older at the time of participation. You are not eligible if you or any member of your immediate family or household (whether or not related) is (A) an employee, officer or director of (1) Sponsor, its bottlers or distributors, respective parent, affiliated and subsidiary companies, (2) Yahoo! Inc., any promotional partners, advertising or promotions agencies, suppliers of Contest materials, internet promotion developers, judging or administration organizations, or auditing or legal firms and other parties engaged in the production, promotion, administration or execution of the Contest (collectively with Sponsor, the "Contest Parties"), (3) redemption/recyclingcenters, or (4) an owner/operator or person responsible for purchasing or promotion decisions at retailers that sell Sponsor products. "Immediate family" means parents, children, stepparents, stepchildren, siblings, stepsiblings and spouses, whether or not living at the same residence. Winners must have a valid Passport to accept Grand Prize.
GENERAL CONDITIONS: This Contest is governed by the laws of the United States. All federal, state and local laws and regulations apply. By participating, you accept and agree to abide by the Official Rules and all decisions of the Contest Parties, which are final and legally binding in all respects. No substitution or transfer to a third party of all or any part of prize permitted. If, for any reason, a prize cannot be awarded or winner is not capable of redeeming a prize, Sponsor is not obligated to award it and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize)with a prize of comparable or greater value or cash value. If, for any reason, more prizes are availableor claimed than the stated number, Sponsor reserves the right to randomly drawwinners from eligible prize claimants in such prize category. Winnersare solely responsible for all federal, state and local taxes, if any, on prizesand any expenses not specifically awarded in the Official Rules, and may beissued an IRS Form 1099 that documents the value of the prize for tax purposes. Non-compliance with these Official Rules may result in disqualification. You are not a winner unless and until (A) your entry is received (B) you have fully complied with the Official Rules and (C) all verification and award processes have been completed. Acceptance of prize constitutes permission for Sponsor and its designees to use winner's nameand/or likeness for purposes of advertising and promotion in any medium, without further compensation, except as prohibited by law.
RELEASE OF LIABILITY: BY ENTERING THE CONTEST, YOU HEREBY AGREETHAT IN NO EVENT WILL SPONSOR OR THE CONTEST PARTIES BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS,ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSELFEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:
- THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE CONTEST (OR YOUR PARTICIPATION INIT);
- CANCELLATION,MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE CONTEST;
- USE OF ANY WEBSITE(S) RELATED TO THE CONTEST OR MATERIALS ON THE WEB SITE;
- ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THEPRIZE; OR
- PARTICIPATING IN OR TRAVELING TO ANY CONTEST-RELATED ACTIVITY.
Except where prohibited by law, a winner's acceptance of a prize constitutes permission for Contest Parties to use such winner's name, address (city and state only),statements, photograph, video, voice or likeness for any advertising and promotional purposes relating to the Contest without further compensation, consideration, review or consent.
LIMITATIONS: Neither Sponsor nor any other Contest Party is responsible for:
- lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email;
- any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues;
- unauthorized access, tampering, hacking, theft or destruction; or
- other technical or human error in the receipt or processing of entries, game piece requests orother submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Contest.
TAMPERING/VIOLATIONS/DISRUPTION: Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Contest or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person, violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service.
CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.
CANCELLATION/MODIFICATION: Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Contest if the Contest is not capable ofrunning as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Contest).
NO PRIZE WARRANTY: WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
DISPUTES: IF NOT RESOLVED THROUGH DIRECT DISCUSSIONS, ANY CLAIM SHALL BE RESOLVED BETWEEN PARTICIPANT AND SPONSOR BY FINAL AND BINDING ARBITRATION WITH AN EXPERIENCED ARBITRATOR LICENSED TO PRACTICE LAW IN TEXAS. FORUM AND VENUE FOR ANY ARBITRATION PROCEEDINGS WILL BE IN COLLIN COUNTY, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE RULES, BE LIMITED TO ACTUAL OUT OF POCKET DAMAGES, AND SHALL NOT, IN ANY EVENT, INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEY'S FEES OR COSTS OF BRINGING A CLAIM, OR ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF.
